Consumer Protection & Antitrust Bureau

The Consumer Protection & Antitrust Bureau seeks to protect New Hampshire consumers from unfair or deceptive business practices and to ensure open and fair competition in this state.

The Consumer Protection and Antitrust Bureau enforces state and federal laws that make unfair and deceptive business practices unlawful. The Bureau also enforces state and federal antitrust laws that protect free and fair competition and safeguard against the unlawful abuse of monopolistic power. Furthermore, the Bureau investigates and prosecutes the most serious cases of elder abuse and financial exploitation.

Additional Consumer Protection & Antitrust Bureau Enforcement Areas

In addition to enforcing the Consumer Protection Act, the Bureau has the authority to enforce several other laws protective of consumers, including but not limited to laws relating to the sale of motor vehicles, housing, and the provision of consumer goods and services:

Motor Vehicles

  • Disclosure requirements for sales of salvaged or rebuilt vehicles.  RSA 261:22.
  • Certain conduct that vehicle manufacturers, representatives, distributors, and dealers are prohibited from engaging in.  RSA 357-C:3.
  • Requirements for event data recording devices in vehicles.  RSA 357-G:1.  
  • Requirements for motor vehicle repair facilities.  RSA 358-D:12. 
  • Failure of a motor vehicle dealer to inspect used vehicles or advise a customer of her rights, or concealment of a defect that should have been discovered during an inspection.  RSA 358-F:4.   
  • Rules governing the identification, kind and quality, limitations on use of, and disclosure related to after market car parts provided by manufacturers.  RSA 407-D:5. 

Housing

  • Posting requirements in housing for older persons or independent living retirement communities.  RSA 161-M:5.
  • Rules governing manufactured housing installation standards.  RSA 205-D:16. 
  • Rules governing rental referral agencies.  RSA 358-H:5. 

Consumer Goods and Services

  • Unfair, deceptive, or unreasonable debt collection practices.  RSA 358-C:4. 
  • Regulation of advertising of auctions, collusive bidding practices, and disclosure of buyers’ premiums.  RSA 358-G:3. 
  • Restrictions on flea markets’ ability to offer or sell infant formula, expired food manufactured for infants, and certain drugs.  RSA 358-Q:2. 
  • Rules governing door-to-door sales solicitations and disclosure of information for any seller of consumer goods or services.  RSA 361-B:3.
